Energy Benchmarking for AB 1103

Energy Benchmark ReportThe California Energy Commission adopted California Code of Regulations, Title 20, Sections 1680-1685, the Nonresidential Building Energy Use Disclosure Program – also known as Assembly Bill 1103 (AB 1103).

Assembly Bill 1103 requires nonresidential building owners in California to benchmark a building’s energy use before of the sale, lease, financing or refinancing of the entire building.  It requires non-residential business owners to input energy consumption and other building data into the Environmental Protection Agency’s ENERGY STAR Portfolio Manager system.

Who has to Comply?

A building owner/operator is required to benchmark and disclose a building’s energy use if the answer to all of these questions is “YES”.

  1. TRIGGER TRANSACTIONS.  Is your ENTIRE nonresidential building offered for sale, lease finance or refinance?
  2. BUILDING SIZES.  Is your building over 5,000 square feet?
  3. OCCUPANCY TYPES.  Is your building classified as any occupancy type other than Factory/Industry (F) or Residential (R) ?
